REDWOOD CITY — A Daly City market owner accused of firing a gun at a pair of fleeing robbers has been ordered to stand trial on charges including attempted murder, prosecutors said.
On Thursday, Judge Amarra A. Lee held Rocky David Eid, 51, of Daly City, to answer on two counts each of attempted murder and assault with a semiautomatic firearm, as well as one count each of felon in possession of a firearm and felon in possession of ammunition, according to the San Mateo County District Attorney’s Office.
Eid was also held to answer on an additional charge of discharge of a firearm in public.
In addition to ruling that enough evidence exists to try Eid on the charges, Lee rejected a claim by his attorney that the use of force was valid to apprehend a fleeing felon, prosecutors said.
The incident happened June 20, 2023, at the Sun Valley Dairy Market, located at 615 Schwerin St. in Daly City.
Eid was behind the counter when two men entered the store, told him not to move and took his Rolex off his wrist, according to prosecutors. The men then ran from the market.
Eid, a twice-convicted felon, grabbed a handgun from under the counter, followed the robbers and fired a total of eight shots at them, prosecutors said. One man, who was about 100 feet away, was struck once in the neck and once in the shoulder.
The robbers got into a car driven by a third person, according to prosecutors. The injured man was taken to a hospital, where he remains hospitalized with injuries that are not considered life-threatening. His accomplices have not been identified or arrested.
Prosecutors said Eid told Daly City police officers he did not see any weapons on the men, but he was concerned that they would return and wanted to scare them away.
Eid has two prior felony convictions and is prohibited from possessing a firearm, according to prosecutors.
The case was continued to Feb. 15 for a superior court arraignment. Eid remains out of custody on a $750,000 bail bond.
