A Florida woman poured Diet Mountain Dew soda on herself in an attempt to destroy DNA evidence linking her to the murder of her roommate, according to police.
35-year-old Nichole Maks was charged with tampering with evidence after police said she poured the soda on her head when they notified her that they would be looking for DNA evidence.
Early on July 1, a Daytona Beach police officer was flagged down by a resident about a fire at a home on Clark Street. When firefighters extinguished the fire, they found a man dead on the floor of the house with blunt force trauma to the back of his head. He also had stab wounds to his torso, according to an affidavit.
Police identified the man as 79-year-old Michael Cerasoli.
Police then put out a bulletin seeking Maks as a person of interest in the case. She was later found by an officer who said she was shoeless but had ripped clothing and blood on her leg. The police report said she dropped a knife and a hammer when police confronted her.
When questioned, Maks allegedly gave contradictory accounts and said she was homeless while later admitting she was Cerasoli’s roommate.
Then she allegedly poured the Diet Mountain Dew on her head.
Police said that Maks’ DNA was found on a knife at the murder scene while the DNA of the victim was found on the blade of the knife.
Maks was also charged with first-degree murder and resisting arrest with violence. She was booked into the Volusia County jail and held without bond.
She entered a written plea of not guilty. Defense attorneys argued that Maks was mentally incompetent to stand trial.
