DUBLIN — A fatal shooting Sunday at an apartment complex where a man was killed after he attacked another man with a baseball bat is being investigated as a case of self defense, police said Tuesday.

The name of the man killed, a 38-year-old Castro Valley resident, has not been released. Police have also not released the name of the shooter.

The deadly confrontation happened about 4 p.m. Sunday at an apart ment complex in the 7100 block of San Ramon Road, where the man who did the shooting lives.

Police said the man was in a relationship with a woman, who was also at the apartment, when the 38-year-old man — her estranged husband — showed up unannounced. The man who lives at the apartment did not know the estranged husband, authorities said.

How the man knew his estranged wife was at the apartment is under investigation, Dublin police Capt. Nate Schmidt said.

The Castro Valley man had a baseball bat with him and began hitting the other man, Schmidt said. The resident, fearing for his life, was able to get a shotgun and shoot the man, Schmidt added.

The wounded man was pronounced dead at the scene. The resident was treated at the scene for injuries but did not require hospitalization.  The woman was not hurt.

Schmidt said the resident was detained for questioning but was later released.

The case will be presented to the Alameda County District Attorney’s Office; prosecutors will determine if any charges are warranted.

The killing is the third homicide investigated by Dublin police this year.
